Storm ("we," "us," or "our") provides weather information, live video, and video on demand content. These Terms of Service govern your use of our Site and services.

1. Acceptance of Terms

By accessing or using the Site, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Site.

2. Who May Use the Site

You must be at least 13 years old. We do not offer user accounts to the general public; administrator access is limited to authorized personnel.

3. What We Provide

Storm offers weather information, live and recorded video, and related content. Some pages include embedded services, including YouTube video players and live chat. We may update, suspend, or discontinue any feature at any time.

4. Privacy

Your use of the Site is also governed by the Storm Privacy Policy. We use first-party cookies for essential and preference purposes. For local weather, we use your IP address (approximate location), and, if you opt in, your device’s precise location; we do not store this location data beyond fulfilling your request. Third parties (including NWS, Nominatim, EPA, and our Storm API/service providers) may process requests to deliver content.

5. Third-Party Services and Links

The Site includes links to and embeds from third parties (e.g., YouTube, Discord, Twitter/X, Google Forms). Your use of those services is governed by their terms and privacy policies. We do not control and are not responsible for third-party content, policies, or practices.

6. Acceptable Use

You agree not to:

• (a) misuse the Site, interfere with its operation, or attempt to access non-public areas;
• (b) use automated means (bots, scrapers) to extract data, except for standard web indexing by search engines;
• (c) submit or transmit content that is unlawful, harmful, defamatory, harassing, or infringes intellectual property or privacy rights;
• (d) attempt to reverse engineer, decompile, or otherwise derive source code or underlying ideas of any part of the Site except to the extent permitted by law.

We may take any action we deem appropriate (including rate limiting, blocking access, or contacting service providers) to protect the Site.

7. Intellectual Property

All content on the Site (including video, graphics, text, logos, and code) is owned by Storm or its licensors and is protected by law. You receive a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may link to publicly accessible pages but may not use Storm’s trademarks or brand assets without prior written permission.

8. No Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORM AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY. Weather and environmental data may be incomplete, delayed, or inaccurate.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR SECURITY, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID TO USE THE SITE (IF ANY), WHICHEVER IS LESS.

10. Indemnification

You agree to indemnify and hold harmless Storm and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Site; (b) your violation of these Terms; or (c) your violation of any law or third-party right.

11. Changes to the Terms

We may update these Terms from time to time. The “Last updated” date reflects the latest changes. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

12. Termination

We may suspend or terminate access to the Site at any time, with or without notice, for any reason. Upon termination, the rights granted to you under these Terms will end.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Travis County, Texas.

14. DMCA/Copyright Concerns

If you believe content on the Site infringes your copyright, contact us with: (a) your contact details; (b) a description of the work claimed to be infringed; (c) the location (URL) of the allegedly infringing material; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement under penalty of perjury that the information is accurate and that you are the owner or authorized to act; and (f) your physical or electronic signature.
